VitaKeeper APP User Agreement

Welcome to VitaKeeper APP (hereinafter referred to as "this product"). Before using this product, please carefully read the following user agreement (hereinafter referred to as "this agreement"). This agreement applies to all users of this product and is entered into between you and us (hereinafter referred to as "we" or "the Company"). By using this product, you indicate that you have read, understood, and agree to all terms of this agreement. If you do not agree to any content of this agreement, please do not use this product.

I. Service Content

• Service Scope: The company provides download, installation, use, and updates of this product, including but not limited to: health data recording (blood pressure, blood sugar, blood lipids, BMI, etc.), health reminders and care plan management, family member health record management, health data statistical analysis and report generation, OCR image recognition functionality, health standards query, and other services. Specific service content may change with product updates, and users can check the latest version of this agreement at any time.
• Service Interruption and Termination: The Company reserves the right to adjust, suspend, or terminate part or all services at any time without prior notice to users. However, the Company should make every effort to inform users before service interruption or termination.

II. User Behavior Standards

• Legal Use: Users promise to use this product only for legal purposes and shall not use this product to engage in any illegal, non-compliant, or activities that harm others' rights and interests.
• Prohibited Content: Users shall not upload, disseminate, or publish any illegal, pornographic, defamatory, violent, malicious, infringing, or false health information through this product.
• Data Authenticity: Users should ensure that the input health data is true and accurate, and shall not intentionally input false information. False data may affect the accuracy of health analysis and even mislead user health.
• Account Security: Users are responsible for protecting their account security and shall not disclose account information to others. If account theft is discovered, contact us immediately.
• Prohibited Behavior: Users shall not engage in the following behaviors: reverse engineering, cracking, modifying this product; spreading viruses, malicious code; interfering with the normal operation of this product; infringing on others' intellectual property rights, etc.
• Intellectual Property: All contents, technologies, and data in this product, including without limitation software code, images, texts, and health management plans, are owned by the Company or its licensors and protected by copyright and other intellectual property laws. Users shall not copy, modify, distribute, display, transfer, or otherwise infringe the intellectual property rights of the Company or any third party.

III. Privacy and Information Security

• Privacy Policy: The Company promises to respect users' privacy rights and protect the security of users' personal information and health data. For specific personal information collection, use, and protection measures, please refer to the Company’s "Privacy Policy".
• Information Security: The Company will take reasonable security measures to protect users' personal information and health data from unauthorized access, use, or disclosure. However, users should understand that no internet transmission can be 100% secure, and the Company cannot guarantee absolute security.

IV. Service Fees and Subscription

• Free Features: This product provides free basic health data recording, including blood pressure, glucose, BMI, lipid records, family member management (up to 10), basic reminders, 7-day charts, photo OCR, and PDF health report export (once per month, last 7 days of data only).
• Premium Subscription: A paid subscription unlocks: 30/90-day trend charts, health insights, unlimited PDF health report export (any time range), cloud backup with multi-device sync, CSV data export, advanced reminder templates, and ad-free experience.
• Subscription Prices: Monthly $2.99/month, quarterly $7.99/quarter, yearly $27.99/year. Actual prices are displayed on the App Store and may vary by region and currency.
• Auto-renewal: Subscriptions automatically renew within 24 hours before expiration, charging your iTunes account for the current period. To cancel, turn off auto-renewal in Settings → Apple ID → Subscriptions at least 24 hours before expiration.
• Restore Purchase: If you change devices or reinstall the App, use the "Restore Purchase" button on the subscription page to reactivate purchased subscriptions.
• Third-party Services: This product uses third-party services including: Umeng (analytics), on-device text recognition (photo recognition performed entirely on your device), Firebase (push and remote config), Google AdMob and ByteDance Pangle/GroMore aggregation SDK (ads shown only to free users on the splash screen). Costs are borne by us.

V. Disclaimer and Liability Limitation

• Health Information Notice: The blood pressure, blood sugar, blood lipids, BMI data recording and analysis provided by this product are for reference only and are not intended as medical diagnosis or treatment basis. Users should combine their own situation when using this product and consult professional medical institutions when necessary.
• Product Quality: The Company does not guarantee that this product is defect-free, error-free, or fully meets users' expectations. For any direct or indirect losses arising from the use of this product, unless otherwise required by law, the Company shall not bear any responsibility.
• Force Majeure: The Company shall not be responsible for service interruption or inability to use normally due to force majeure events such as natural disasters, government actions, war, internet service interruption, etc.
• No Warranties: To the maximum extent permitted by law, the product and services are provided on an "as is" and "as available" basis, without any express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
• Liability Cap: To the maximum extent permitted by law, the Company's aggregate liability for all claims shall not exceed the fees paid by the user to the Company during the 12 months preceding the event giving rise to liability. If the user paid no fees, the cap shall be USD 0 or the minimum cap permitted by law.
• Exclusion of Damages: The Company shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including but not limited to loss of profits, data, or goodwill.
• Recognition Accuracy: OCR/image recognition features may be inaccurate, delayed, or unavailable; results are for reference only and the Company does not warrant accuracy or completeness.

VI. Agreement Modification and Updates

• Agreement Modification: The Company has the right to modify this agreement at any time and publish the updated agreement content within this product. Users should regularly check the latest version of the agreement. Continued use constitutes acceptance of the modified agreement.
• Agreement Termination: If users violate any terms of this agreement, the Company has the right to unilaterally terminate this agreement and stop providing services.

VII. Governing Law and Dispute Resolution

• Governing Law: This agreement is governed by the laws of the People's Republic of China.
• Dispute Resolution: Any dispute arising out of or in connection with this agreement that cannot be resolved through amicable negotiation shall be submitted to the court with exclusive jurisdiction at the Company's domicile.

VIII. Supplementary Provisions

• Agreement Effectiveness: This agreement takes effect from the date when users click "Agree" or start using this product.
• Independent Terms: If any terms in this agreement are determined by the court to be invalid or unenforceable, the remaining terms remain valid.
• Service Changes: The Company may reasonably update, modify, or discontinue services, features, or interfaces, and will use reasonable efforts to notify users; the Company shall not be liable for losses arising therefrom.
• Third-party Services: Some features rely on third-party services or SDKs (e.g., statistics, push, OCR). The third party is responsible for availability, compliance, and disputes arising from its services; to the extent permitted by law, the Company bears no joint liability.
• User Content License: For content uploaded by users, the user grants the Company a worldwide, irrevocable, royalty-free, sublicensable and transferable license to use, reproduce, adapt, display and distribute such content within the reasonable scope of product operation and promotion.
• Data Backup: The Company takes reasonable technical measures to protect data security but does not guarantee absolute data integrity. Users are advised to back up regularly; losses due to lack of backup shall be borne by the user.
• Fees and Subscriptions: The product is free to download with free core health recording features; advanced features are provided through auto-renewing subscriptions (see Section IV). Subscription terms, prices, and auto-renewal rules are displayed on the App Store.
• Minors and Compliance: Users shall have the requisite capacity and comply with applicable laws; the Company undertakes reasonable and commercially practicable measures for compliance without constituting a guarantee.
